We would like to inform you that the terms and conditions apply to all users of the platform affiliated with the Silaa Platform for Digital Marketing Ltd, which regulates our work system, and that if the terms and conditions are translated into other languages, the Arabic language is the first and original source for all transactions, and in the event of your use and / or registration and / Or your continued use of the platform means that you agree to the terms and conditions, and these terms are in effect.
The terms and conditions are subject to change from time to time, so it is advised to visit the terms and conditions for any updates.
Tariffs:
The platform: It is an online shopping platform for displaying and selling services and products, with a distinctive and integrated customer experience and a smooth user interface that includes services, smart search tools, various payment channels, and multiple shipping methods.
Merchant: It is the user who registered on the platform to offer services or products, or both, whatever this activity may be.
Business page: It is a business page within the platform dedicated to the activity of the merchant, which he uses to carry out all his commercial dealings, whether it is offering or selling services and products.
Customer: It is the user who uses the platform to search and purchase services and products.
Terms and Conditions: The rules and conditions used on the platform that apply to all users and all commercial dealings.
Service Provider: These are the companies that have been contracted to provide services (payment, shipping, and marketing) and have been linked with the platform.
Registration terms:
You have the right to register as a user whether you are a browser, buyer, service provider, or seller and benefit from the platform when the following conditions are met:
Browser

You are not required to register on the platform to view or search for services or products.
Buyer

To have reached the legal age according to the laws and regulations in force in the Kingdom of Saudi Arabia.

To have an address in the Kingdom of Saudi Arabia.
Service provider or seller

To have a commercial register or a self-employment document

To provide proof of identity to the person responsible or authorized on the account.

Submit a bank document to match the bank account with the commercial register or self-employment license.
Your commitment as a user

If you register on the platform, you are required to disclose some information and choose an e-mail as a username and password to use it to login and access the services of the platform.

After registering on the platform as a buyer, you must enter your address, in addition to specifying it on the map, to be able to complete your purchases completely.

After registering on the platform as a service provider or seller, the activity of your account will be confirmed before activating the account. After that, you can access and enjoy the services of the platform.

Commit and maintain the privacy of the account, its access, its uses and agree to take responsibility for all activities that occur under your username.

To be responsible for the confidentiality of your account information and not to disclose the login data to anyone else. If an entry attempt occurs, you must inform us of that attempt.

Notify us immediately of any unauthorized use of the account or any breach of the platform's security standards.

Cooperate with inquiries and correspondence with the platform team when verifying your personal data, commercial activity data, or self-employment document.

Commitment not to publish or include any of the prohibited contents or materials according to the laws and regulations in force in the Kingdom of Saudi Arabia.

The mobile number and e-mail registered in the account is one of the basic means of communication.

You are fully responsible for using your account on the platform, and if you authorize another person to do so, we disclaim our responsibility for that account access.

If you violate any of the provisions, you are obligated to compensate the platform for direct and indirect damages as a result of the loss of login data and access to the account, whether with or without authorization from you.

You shall disclose true and correct information related to you as required of you during registration on the platform, and you shall update your data if it is changed.

Not to indicate the existence of any direct or indirect relationship between you and the management of the platform

In the event of a violation of what was mentioned above, we have the right to stop or freeze your account as a user with us, or to prevent you from entering the platform.

We also have the right to delete any account that is not confirmed or has not been processed for a long time.
Our commitment as a platform

We at the platform are committed to maintaining the confidentiality of your information in accordance with the provisions of our privacy policy.

We have the right in the platform to conduct some investigations that we deem necessary, whether directly or through a third party, and we have the right to demand the disclosure of some additional information or other documents.

We are not responsible for any of the claims arising as a result of financial losses or reputational misuse of the platform or unsatisfactory performance between the merchant or the service provider or the user.

We note that any user must inform us of any suspicious or illegal activity on our site, and we are not responsible for any of these violations.

The platform is not responsible for any material or moral damage that occurs as a result of losing your login data.

Buyer commitment

View and verify the merchant's information and product description, in addition to reading the return and exchange policy before purchasing.

When a dispute occurs in any commercial transaction, you can file a commercial report directly, or you can contact the Consumer Contact Center 1900 of the Ministry of Commerce.
Merchant commitment

Commitment to provide commercial activity data in full, in addition to clarifying the requirements of the E-Commerce Council to ensure and preserve consumer rights.

Presentation of services or products or both in Arabic, clearly and accurately.

Commitment to writing the return and exchange policy for the business.
-
Commitment to provide the means of communication and include the commercial registration number or the self-employment license.

Commitment to include the tax number with a copy of the tax certificate for those whose registration the system required.

Commitment not to publish or include any of the prohibited contents or materials according to the laws and regulations in force in the Kingdom of Saudi Arabia.

Commitment not to act or violate laws and regulations in force in the Kingdom of Saudi Arabia, and if this happens, the merchant is the first and last responsible for these actions and violations.
Terms of business page:

That the business page does not violate the laws and regulations in force in the Kingdom of Saudi Arabia, and the merchant is obliged to clarify the type of business that he performs.

The platform is not responsible for any business page that violates the laws in force in the Kingdom of Saudi Arabia, and we have the right to reject any activity that violates these laws.

No user has the right to use the platform if his membership or business page is canceled by judicial orders or rulings.

The merchant must comply with all applicable laws and regulations in the Kingdom of Saudi Arabia.

If the user (a service provider or seller) represents a private sector, a government agency, or a non-profit organization, he must provide us with all the details and information proving that.
Shipping information:

The platform provides more than 25 shipping companies to provide smart solutions for shipping and managing shipments at the best prices by linking the platform directly with TOROD company.

To activate the shipping service, the merchant is required to specify the type of shipment, whether it is a dedicated shipment (if the merchant has its own representatives) or shipment through a third party (TOROD).

The merchant shall bear any legal expenses or violations when shipping materials in violation of the laws and regulations in force by the Public Transport Authority in the Kingdom of Saudi Arabia.

The merchant is obligated to use the platform and the service provider without intending to cause technical damage or fraud, directly or indirectly.

The merchant is obligated to review the prohibited materials recognized and issued by the Public Transport Authority, and in the event of violating this, his account will be suspended, and the concerned parcel will not be shipped by the service provider (TOROD)

All products, goods and materials are shipped except for large furniture, large plants, large sizes that need heavy transport or a large area, flammable materials, and any products that are prohibited from being transported by shipping companies.
Return and exchange policy

3 days from the date of purchase for the value of the advertising space, unless it is published, except the platform commission.

3-7 days from the date of purchase, 50% of the value of the advertising space, unless it is published, except the platform commission.
Platform commission
A commission of (9%) is deducted from the value of the goods for each transaction, and this commission includes the full use of the platform and the commission of TAP payments.
Note: The platform commission is a non-refundable commission in the event of a refund.
Payment service on the platform

You can pay through TAP payments, and it is only a means to facilitate the process of commercial exchange for the purpose of preserving the rights of both parties, and we have nothing to do with that.

The platform provides tools to facilitate commercial exchange between the merchant and the buyer and is responsible in the buying and selling operations between the merchant and the buyer.

The merchant is committed to determining the price of services and products according to their market value, and we have nothing to do with that pricing.
-
The merchant must commit to providing the necessary information for the electronic invoice, as the invoice template that we issue from the platform is compatible with the terms of the Zakat and Income Authority.
-
We have the right to cancel, amend or change any payment method on the platform.
-
All commercial transactions are calculated in Saudi Riyals, and this is the currency that is dealt with on the platform.
Note: Transfer commission on all transactions is non-refundable in case of return or cancellation of the order.
Transfer period to the merchant's bank account

Mada: 3 working days, provided that the minimum amount is 100 Saudi Riyals

Visa and Master Card: 5 working days, provided that the minimum amount is 100 Saudi Riyals
Note: An additional fee of SAR 5 will be charged for settlements less than SAR 100 when the merchant requests an early transfer by TAP.
Intellectual property rights

All contents of the platform and others are our property, and no one has the right to use them in any way.

We will take the necessary measures in the event of infringement of any of the platform's rights and intellectual property.

We, in the platform, do not bear any infringement of the user's rights.
Freeze or cancel

Without prejudice to any of the rights or remedies or without any liability to you, we have the right to freeze or terminate the account or products or delete content at our discretion. In addition to violating the terms and conditions or we were unable to document any information about the user or the existence of illegal activity
Conditions for evaluating a business
Your evaluation of a business must be based on many criteria that are governed by your experience, and here we show you some conditions that must be considered when evaluating a business:

The evaluation should be clear, accurate and specific in relation to the type of service or product provided.

Make sure that the evaluation is after trying the service or product that you got based on your personal experience.

It is prohibited to use any obscene or offensive language for the commercial activity or the workers in this activity.

It is prohibited to use the evaluation field to resolve any misunderstanding between you and the business or its employees.

The aim of this evaluation is to improve the services/products or customer service provided by the business, so make sure that this evaluation is constructive.
Your personal information and transaction details information:

We give the platform the unlimited right to use personal or other information or materials that have been provided to us by the user to achieve the interests that we see.

The user bears responsibility for the information that he sent or published, and our role is limited to displaying this information through the platform and its advertising channels.

The user must know that his information and business page data are subject to the rules of our privacy policy.
Platform rights:

All contents of the platform and others are our property, and no one has the right to use them in any way.

We will take the necessary measures in the event of infringement of any of the platform's rights and intellectual property.

We, the platform, do not bear any infringement of user rights.
Customer rights:

The customer has the right to communicate directly with the merchant in the event of non-receipt of the goods or receipt of different goods, the full value of which has been paid.

The customer has the right to communicate or file a commercial report with the Ministry of Commerce if the merchant does not respond.
-
The customer has the right to review the goods before receiving them to ensure their correctness, safety, and conformity, as the platform is not responsible for the relationship between the merchant and the customer.

We are not committed to the platform with any complaint by the customer and we take appropriate measures based on what we deem appropriate.
Value added tax policy:
The merchant is obligated to review the terms of registration for value-added tax through the website of the Zakat, Tax and Income Authority, where we provide the feature of activating the deduction of (15%) for the tax on the invoice issued for your sales for those who have reached the limit of the tax registration quorum.
Note: Issuance of a tax invoice by an unregistered person (the violator shall be punished with a fine not exceeding (100,000) one hundred thousand riyals by the Zakat, Tax and Income Authority, without prejudice to any harsher penalty stipulated in any other system.
